At GAIA we advise companies and sole traders on tax law, with the aim of keeping the business compliant and protecting its position when that position is tested.
Our tax lawyers work on the questions that go beyond routine filing: how a provision should be interpreted, what position the business can properly take, and how to conduct a matter once the tax authorities have opened one.
The purpose is to put the business on firm legal ground, identify where tax risk actually sits, and make sure significant decisions are taken with a defensible strategy behind them rather than after the fact.
Tax strategy
Tax law is not only about meeting obligations. It is about examining how the business is structured and arranged, and building a tax position that is efficient and will hold.
We look at each case individually and advise on reducing the tax burden within the law, with the reasoning documented. Efficiency that cannot be explained to an inspector is not efficiency.
Tax enquiries, inspections and disputes
We advise and represent businesses in proceedings before the Spanish Tax Agency, including formal requests, compliance checks and full inspections.
We handle the matter from the first letter: preparing the documentation, framing the response, and arguing the company's position. How the early stages are conducted usually determines how the matter ends.
Tax analysis of corporate transactions
We advise on the tax implications of corporate transactions - restructurings, mergers and the purchase or sale of a business - and assess what each option would cost.
Tax is frequently the factor that determines whether a transaction is worth doing in the form proposed. Establishing that in advance is considerably better than discovering it afterwards.
